:bulletred: Before I start this, if anyone is even thinking of lifting this journal like Captain Assclown with my last journal....may DA throw the wrath of every single of one of my 3000 some odd watchers at the person who does. Thank you.

Now in light of said Captain Assclown spreading his disinformation with his latest journal on copyright, I thought I would do a little primer of it for you guys. One thing you must know however at this stage in time, many of the laws are evolving & changing. And the things which I write here may be gone in a year, especially with the Orphan's Right Bill which I am VERY against. I feel this bill is bad for artist's and does nothing but hurts creative's. Regardless of what DA's stance is, with supporting it. There are MANY professional organizations against this bill, I stand by my them. So....without farther delay, let me just say if yo guts have any questions, once again please feel free to ask and I will answer the best to my abilities. Now on with the show!

:star: How is my work ©? When does it start?--- The very second you create anything, it is copyrighted to you. The second you start drawing, the second you push the shutter release, the second you write, it is © to you, and you alone.

star: What about Creative Commons?--- Honestly, I am VERY anti-creative commons, and I make no bones about it. It is awful, and benefits no one but some one who wants your work for essentially free and to use it. If you are making wallpaper packs, doing open source software, fine, ok. But this is focused with photography in mind, and for that, it plain sucks. Those of you who have CC licenses attributed to your images, I URGE you to reconsider this asap. Your images CAN and it is likely, WILL be used commercially with NO benefit to you period. How serious of an issue is this? Go read this---- How Every Flickr Photo Ended Up on Sale This Weekend

:star: Is My Idea © ? --- No, ideas are not ©. Now, apparently Captain Asshat thought my last journal was an 'idea' for some unknown reason. BUZZ! WRONG! Ideas are what are in your head. Say you have an idea for, I don't know, Pizza Ovens, that idea in your head is not ©. However, the very second you start writing it down, it is. The very second you start doing a mock up, it is. The very second you do a 3D model of it, it is.

:star: Do I have to register my work?--- technically you should but you don't have to. Now, here is where it gets a tad iffy. Some sources say yes, if you need to after someone legally, then yes you must have it registered. Now others say no, you only must prove it to be yours. You be the judge.

:star: What are some links for © info?--- Ok the following links are quite useful---

:star: Should I sign my work with my name and © ?---- YES, without any question at all, if you are posting YOUR work here or anywhere else, it is in your best interest to sign it with your REAL name and © symbol. Think of it this way, if your image is used by some big company (It CAN and DOES happen!!!!) and you wind up in court, how is it going to look when xXkittyOfDeathSlitMyWristsXx is trying to defend their work in front of a judge. Think about it. It's kinda like always having clean underwear on in case you have to call an ambulance.

:star: What else can I do to protect my work with © ?---- Start filling out the metadata in your images in a program that supports this, like Xnview which is free. This embeds your name and everything like keywords into the image itself.

Ok I know this is pretty basic, but I wanted to do it on a basic level without the whole legal babble and give you guys some suggestions and make it easy to understand. Again, if any of you have any questions, just ask! Myself or some of my watchers will answer ya!



Again, focusing on images which do not get seen and sure as heck should be seen! Swing by them, leave a comment, and tell em what ya think! Many of these have hardly any feedback or fav's at all, and heaven knows they deserve it!

Small ad on that I think is important in relation to copyright laws.
I know that what you've done here is just a primer and I commend you on what you've done and perhaps I am going to go a little overboard, but I feel this is important and needs to be said.

In most cases if any work you do for a company, becomes property of that company, be careful of what you sign before you accept a job. Most companies will require you to sign an Intellectual Rights Agreement thus negating any hold or claim you have over ANY thing you do (while at work :)). Don't do your buddies website while at work.

On the point of © and ideas; You're right ideas can not be copyrighted. The idea can only be protected under copyright law as a creative piece through literary work ie: ( If I have an idea for a play, I write it out, it's protected as a literary work (and includes Derivative works) or if write I would like to do this for a pizza oven…;). Only the literary work is protected, no one can in turn take what you have written down and reproduce that literary work, however, this does not protect or subject the Idea to Patent Law. There is no stopping someone from taking that Idea and Patenting it, so be careful.

2 Point in case,
Tesla and Marconi. Tesla claimed he had an idea for the radio, due to a fire Tesla lost his notes (convenient?)... in short Marconi beat Tesla to the Patent office thus becoming the inventor of the radio.

Gene Roddenberry (yeah Star Trek) had an idea for a Tri-corder (a device that records various things...), he wrote it down (or rather one of his writers did), as a literary piece it is protected, but under Patent Law it's free game. A company Vital Technologies Corporation has patented and developed (or is developing ) this idea. The same could also be said about modern day cell phones—technically, it was Roddenberry's idea.

My point is; copyright law, patent law, trademark—very complicated, if you have an idea seek help, especially with inventions.
